What is the effect of an international patent application?

In general terms, your international patent application, provided that it complies with the minimum requirements for obtaining an international filing date, has the effect of a national patent application (and certain regional patent applications) in or for all PCT Contracting States.

Are patent filings public?

General Rule: U.S. Patent Applications Are Published After 18-Months. Hence, after a U.S. patent application is filed, it is published by the U.S. Patent Office for the public to view even if it hasn’t been granted as a patent yet. Published patent applications can also be searched on the U.S. Patent Office website.

What is international patent application?

The Patent Cooperation Treaty (PCT) is an international patent law treaty, concluded in 1970. It provides a unified procedure for filing patent applications to protect inventions in each of its contracting states. A patent application filed under the PCT is called an international application, or PCT application.

Are patents filed in India internationally accepted?

There is no concept of global patent. However, filing an application in India enables the applicant to file a corresponding application for same invention in convention countries or under PCT, within or before expiry of twelve months from the filing date in India.

Since the rights granted by a U.S. patent extend only throughout the territory of the United States and have no effect in a foreign country, an inventor who wishes patent protection in other countries must apply for a patent in each of the other countries or in regional patent offices.

Can I file a secrecy order with the European Patent Office?

Please note that applications subject to a secrecy order cannot be filed directly with the European Patent Office since no reciprocal security agreement with this organization exists. Applications must be filed in the individual EPO member countries identified above.

What happens if an applicant fails to reply to a patent?

(a) If an applicant of a patent application fails to reply within the time period provided under § 1.134 and § 1.136, the application will become abandoned unless an Office action indicates otherwise.

Is there an international system for the grant of patents?

There is currently, no universal, international system for the grant of patents. Do I need a patent attorney/agent to prepare and file a patent application? In general, applicants can prepare their patent applications and file them without assistance from a patent attorney.
