Where is ticket scalping legal?

Laws about ticket scalping vary by state, and there is no federal law that prohibits the practice. Approximately 16 of the 50 states have a law that makes scalping illegal. Seven states — Alabama, Georgia, Illinois, Massachusetts, New Jersey, New York and Pennsylvania — require a special license to resell tickets.

Why is ticket scalping illegal in some states?

But in those places where it is illegal, the problem is normally that scalpers move in and artificially deplete the supply of tickets on day-one, then mark up the price of the tickets sufficiently that they recoup their money, even if they don’t actually sell all of their tickets.
