Is it cheating to painting over a photo?
Painting from a photograph isn’t ‘cheating’, says our columnist Laura Boswell. Used correctly, it’s a vital tool for developing an artwork.
Are pictures of art copyrighted?
In the U.S., we value the ability of artists and other creative people to make money from their own work. Therefore, artworks that were created since 1976 are automatically copyrighted by the original artist as soon as they are completed, and only the artist can determine who else can make money from their work.
Is redrawing a photograph copyright infringement?
It can be copyright infringement to make a drawing based on a photo that copies just the pose. But you could have a good “fair use” defense to a copyright infringement claim if, for example, the drawing is political and not commercial, and has a neutral or positive effect on the original work.
What is considered cheating in art?
There is no “cheating” in art, unless you are outright stealing someone else’s work or ideas and claiming them as yours. Selling paintings you did and lying, and saying that they were painted by a famous painter would be a form of “cheating”, but tracing something as a guide is not. You are not doing anything deceptive.
Can you get sued for tracing a painting?
If you must trace, then you are not yet an extremely accomplished artist, nothing more. If you are trying to sell a portait as an original painting and you have traced someone else’s photo of the person and transferred it to the canvas, you would not be sued over it.
Is tracing considered cheating?

Are trace artists photocopying photos?
Artists who trace are not photocopying machines like the aforementioned commenter on Facebook claimed. All tracing involves is getting the outline down onto the paper quickly and efficiently.
