Is Gibraltar still part of the EU?

Gibraltar is not part of the UK, but contrary to all other British Overseas Territories was a part of the European Union like the UK. It participated in the Brexit referendum and it ceased, by default, to be a part of the EU upon the UK’s withdrawal.

Is Gibraltar joining Schengen?

Has Gibraltar joined the Schengen Area? The new UK/Spain deal for Gibraltar means that the British colony will indeed join the Schengen Area for passport-free travel, and will now be included in the Schengen Agreement between the other 26 member countries.

Is Gibraltar in the EU for VAT?

Gibraltar is part of both the European Union and the European Economic Area for most purposes. Gibraltar is excluded from the customs union, common customs tariff, common agricultural policy and the requirement to apply VAT on goods and services. Gibraltar is not part of the EU customs areas nor VAT area.

Can EU residents enter Gibraltar?

Passports are required by all visitors to Gibraltar, except EU nationals who are in possession of a valid national identity card. All other nationals require a passport or other recognised travel document. Stateless persons or nationals from certain countries require a visa to enter Gibraltar.

Can EU citizens work in Gibraltar?

If you have an EU passport or reside in an EEA member country you will be able to work freely in Gibraltar. Non-EU nationals must apply for a work permit to work in Gibraltar. Work permits in Gibraltar are issued for 12 months. After this, if a worker is intending to stay in Gibraltar, the permit must be renewed.

Are the Canary Islands in the EU customs union?

While the Canary Island are a part of Spain, and indeed controlled by the Spanish central government, we also have our own political management as well. The Canary Islands, including Fuerteventura, are politically within the European Union, however, they are outside the European Union customs territory and VAT area.

How will Gibraltar’s new EU status affect travel to Spain?

Now that Gibraltar will become part of the Schengen Area, the way Gibraltarians travel to Spain will not change following the end of the Brexit transition period.

Is Gibraltar affected by the withdrawal agreement?

Gibraltar was a part of that agreement. The Withdrawal Agreement included a transitional phase until the end of 2020, which also covered Gibraltar. However, at the same time, Gibraltar worked closely with the United Kingdom for the eventuality of an EU departure without an agreement.

Will the Gibraltar dispute affect the Brexit trade agreement?

Any dispute which Spain has or may have over the sovereignty of Gibraltar will also no longer affect a future trade agreement between Britain and the EU. On 22 November 2018, Pedro Sánchez threatened that Spain would veto Brexit if Spanish concerns over Gibraltar were not addressed.

What does the Gibraltar deal mean for Spain and Gibraltar?

“With this [agreement], the fence is removed, Schengen is applied to Gibraltar… it allows for the lifting of controls between Gibraltar and Spain,” said Ms González Laya. The Gibraltar deal will mean the EU sending Frontex border guards to facilitate free movement to and from Gibraltar. Their role is planned to last four years.
