How long can Mutah last?

Unlike a Nikah, or permanent marriage, a Mutah marriage needs to have a set time frame. There is no minimum or maximum time that the marriage needs to last, though many say that it should last at least 3 days.

How do you end Mutah?

A woman in a Mutah marriage cannot terminate the marriage. Say, “I donate you the time period” (‘ana ‘atabarae lak alfatrat alzamania) in Arabic to separate and terminate the contract. If you terminate the marriage early, it is obligatory for you to still provide the dowry you agreed upon.

Muta marriage is defined as a temporary union of male and female for a specified duration, on payment of some consideration. It is practised only by the Ithna Asharia Shias. It regarded as a temporary marriage. Muta is an Arabic word meaning ‘enjoyment’; therefore, it may be regarded as ‘marriage for pleasure’.

Most commentators hold that the words used in the verse, such as “Istimta'” signifies temporary marriage literally and idiomatically, and denying such a meaning necessitates something contrary to permanent marriage.

What are the rights of a Muta marriage?

No right of divorce is recognized in the case of a muta marriage, but the husband may at his will put and end to the contact of marriage by making a gift of the term to the wife, even before te expiration of the fixed term. If muta marriage is not consummated, the woman is entitled to half the dower.

A muta wife is not entitled to maintenance under Shia law. She was, however, held to be entitled to maintenance as a wife under the provisions of section 125, Code of Criminal Procedure, 1973 in Luddun v. Mirza Kumar.
