Does freedom of speech violate human rights?

The right to freedom of expression is enshrined in Article 19 of the Universal Declaration of Human Rights, which sets out in broad terms the human rights that each of us has. It was later protected legally by a raft of international and regional treaties.

What can people not use freedom of speech to do?

Freedom of speech does not include the right:

  • To create a clear and present danger or likely to incite imminent lawless action.
  • To make or distribute obscene materials.
  • To burn draft cards as an anti-war protest.
  • To permit students to print articles in a school newspaper over the objections of the school administration.

Why there should be limits on freedom of speech?

While we do have freedom of speech in the United States, there should be a limit on it. One key example of how words are so powerful is the Constitution itself. Words are subjective. For example, if we recognize that our speech is becoming slanderous or harmful to another person, it should be frowned upon.
