Can my ex use my old lawyer?

No it cannot. Your old attorney cannot represent your husband unless you have waived any conflict of interest.

Can I represent a relative in court?

You legally can have a relative, family friend, or even yourself be the primary representative in your case. However, having a family member who represents you who is not an attorney would not be too different from having an attorney.

Can an advocate represent his relative?

An advocate can represent their family members, except in the following situations: An advocate shall not appear in any case in which the outcome of the case will benefit him/her monetarily. An advocate shall not appear in a case in which he/she is or can be a witness to the case.

Can a lawyer represent you twice?

An attorney can represent you in an unlimited amount of cases so long as there is not a conflict of interest. The conflict of interest would be that your case is against another client of the attorney’s, or something similar. The problem is whether or not the attorney will want to take any of the additional cases.

Can 2 people use the same lawyer?

Short answer is Yes. However, it is almost always inadvisable to do so. Two people can waive any and all conflicts and, thus, retain one lawyer to represent them. They also have the right to negotiate any fee they want.

Can a lawyer fight his own family case?

Provision for Fighting One’s Own Case as per Advocate’s Act. Section 32 of the Advocate’s Act clearly mentions, the court may allow any person to appear before it even if he is not an advocate. Therefore, one gets the statutory right to defend one’s own case through Advocate Act in India.

Can a lawyer defend his family?

Yes, a lawyer may defend his own family member in court. An attorney-client relationship shall not be formed due to the response to the asked questions.

Can a former client represent another person in court?

(a) A lawyer who has formerly represented a client in a matter shall not thereafter represent another person in the same or a substantially related matter in which that person’s interests are materially adverse to the interests of the former client unless the former client gives informed consent.

Can a lawyer represent different clients in the same matter?

[11] When lawyers representing different clients in the same matter or in substantially related matters are closely related by blood or marriage, there may be a significant risk that client confidences will be revealed and that the lawyer’s family relationship will interfere with both loyalty and independent professional judgment.

Is it improper for a lawyer to represent my wife now?

The fact that the lawyer represented you in the past, in and of itself, does not make it improper for him to represent your wife now. The question is whether in representing you in the past the lawyer learned confidential information that will help him in handling the divorce against your wife.

Is it legal for a lawyer to represent an adversary?

The answer is no if the lawyer who previously represented you received confidential information about you from you that the lawyer now is using against you. If the matters are totally unrelated, and there would be no appearance of impropriety for the lawyer to represent your adversary, then maybe.
