Any American citizen who wants to launch a rocket or other kind of spacecraft into orbit must obtain authorization from the FAA, as would any foreigner who launches within U.S. territory. The FAA regulates the commercial sector’s space activities by requiring parties to obtain launch and re-entry licenses.

Article VII of the Outer Space Treaty requires that “Each State Party that launches or procures the launching of an object into outer space, including the Moon and other celestial bodies, and each State Party from whose territory or facility an object is launched, is internationally liable for damage…”

Who are considered as launching States?

1) Each space object has at least one, and often more than one, launching State. 2) Being a launching State means, inter alia, being liable for any damage that the space object may cause on Earth or in space.
